Welcome to Vertigo Guardian. By creating an account or using our Service, you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, you may not use the Service.

1. Description of Service

Vertigo Guardian is a health information and monitoring platform that correlates atmospheric data with personal health patterns to provide a personalized vertigo risk score, alerts, and educational resources. The Service includes:

• Real-time weather and atmospheric monitoring for your location.
• Personal health logging and analytics.
• AI-powered medical information and symptom analysis.
• Email and push notification alerts.
• Community forums and telehealth provider directory.
• Curated medical resources and treatment guides.

3. Account Registration

• You must provide a valid email address to create an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must be at least 13 years old to use the Service.
• You agree to provide accurate information and update it as needed.
• One person may not maintain multiple free accounts.

4. Subscriptions and Billing

• The Service offers a free plan and a paid Premium plan with additional features.
• Premium subscriptions are billed monthly through our payment processor (Stripe) on our secure website.
• You can cancel your subscription at any time from Settings. Access to Premium features continues until the end of your current billing period.
• Payments are processed on our website, not within the mobile app. Subscriptions purchased on our website are accessible in the app after signing in.
• We may change subscription fees with reasonable notice. Existing subscribers will be charged at their current rate until renewal.
• All fees are non-refundable except where required by law.

5. Free Trial

• New users receive a 30-day free trial of Premium features.
• No credit card is required to start the trial.
• The trial expires automatically after 30 days. Your account reverts to the free plan unless you choose to subscribe.
• We may modify or discontinue the free trial offer at any time.

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose.
• Post harmful, offensive, misleading, or medically dangerous content in community forums.
• Attempt to access another user's data or account.
• Reverse engineer, decompile, or disassemble the Service.
• Use bots, scrapers, or automated tools to access the Service.
• Interfere with the proper functioning of the Service or its servers.
• Share medical advice in community posts that could harm others.
• Impersonate another person or healthcare professional.

7. Community Guidelines

• Be respectful and supportive of other community members.
• Do not share personally identifiable information about others.
• Posts are moderated by AI and human moderators. Inappropriate content may be removed.
• You may post anonymously, but you are still bound by these Terms.
• We reserve the right to remove content or ban users who violate these guidelines.

8. Intellectual Property

• The Service, its design, content, and features are owned by Vertigo Guardian and protected by intellectual property laws.
• Content you post (health logs, community posts, comments) remains yours. You grant us a license to display and process it within the Service.
• Curated medical resources may be subject to third-party copyright. Links to external resources are provided for reference.

9. Telehealth and Third-Party Services

• The Service includes a directory of telehealth providers. We do not employ these providers and are not responsible for their services.
• Consultations, payments, and outcomes with telehealth providers are solely between you and the provider.
• We are not liable for any medical advice or treatment you receive from third-party providers.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that the Service will be uninterrupted, error-free, or that alerts will always be accurate or timely. Atmospheric data and risk scores are estimates and may not reflect actual conditions or your personal health risk.

11. Limitation of Liability

To the fullest extent permitted by law, Vertigo Guardian and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, health, or wellbeing, arising from your use of or inability to use the Service. You use the Service at your own risk.

12. Indemnification

You agree to indemnify and hold harmless Vertigo Guardian and its affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Account Termination

• You can delete your account at any time from Settings.
• We may suspend or terminate your account if you violate these Terms or engage in harmful behavior.
• Upon termination, your data will be deleted in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the applicable jurisdiction.
